التنكيل بحقوقي يمني بارز والحكم بسجنه 8 سنوات

تعرب المنظمات الموقعة على هذا النداء عن قلقها العميق إزاء التدهور المروع لأوضاع حقوق الإنسان باليمن، والذي يدفع بالسلطات اليمنية إلى تصعيد الإجراءات الانتقامية للتنكيل بمدافعي حقوق الإنسان، الذين يبادرون بشجاعة للكشف عن وتوثيق الانتهاكات التي تعم البلاد، وبخاصة في إطار الحرب المشتعلة في صعدة بالشمال، أو في إطار قمع أشكال الحراك السياسي والاجتماعي في جنوب البلاد.

وتندد المنظمات الموقعة على هذا النداء بصفة خاصة بالمحاكمة الجائرة التي استهدفت المدافع الحقوقي ياسر الوزير عضو المنظمة اليمنية للدفاع عن الحقوق والحريات الديمقراطية، الذي تلقى قبل أيام حكما يقضي بمعاقبته بالسجن لمدة ثماني سنوات.

وتؤكد المنظمات الموقعة أن هذه العقوبة الجائرة تمثل تتويجا لسلسلة من الانتهاكات الخطيرة التي استهدفت ياسر الوزير، وهى انتهاكات وثيقة الصلة بنشاطه الحقوقي وبالدور الذي تلعبه منظمته بشكل خاص في توثيق الانتهاكات المتصلة بالحرب في صعدة، والمقترنة بتعريض معتنقي المذهب الزيدي الذين يشكلون أغلبية السكان في صعدة لصنوف شتى من العقاب الجماعي، ولأشكال من التمييز والقمع على أسس مذهبية.

وتجدر الإشارة في هذا السياق إلى أن ياسر الوزير كان قد اختطف قبل أكثر من ثمانية عشر شهرا من قبل جهاز الأمن السياسي، وظل مصيره مجهولا ومحروما من زيارة ذويه لما يزيد على ثلاثة أشهر. ورجحت التقارير تعرضه للتعذيب وإيداعه لفترات طويلة في الحبس الانفرادي، واستمر رهن الاعتقال من دون اتخاذ إجراءات قانونية بحقه، إلى أن قررت السلطات قبيل شهرين فقط إحالته إلى المحاكمة بتهم كيدية، شملت اتهامه بتشكيل جماعة مسلحة، وذلك على الرغم من أن ياسر الوزير لم يخضع لأي استجواب بشأن هذه التهمة.

وقد جرت محاكمته بصورة تكاد تكون سرية ومن خلال جلسات مغلقة لم يخطر بها مسبقا ياسر الوزير، ولم يحضر محام عنه في هذه المحاكمة التي جرت أمام المحكمة الجزائية المتخصصة، وهى محكمة أمن دولة مطعون في دستوريتها، حيث يفتقر الماثلون أمامها إلى العديد من الضمانات القانونية والإجرائية التي تضمن تحقيق العدالة.

وتؤكد المنظمات الحقوقية الموقعة على هذا النداء تضامنها الكامل مع ياسر الوزير، مثلما تؤكد تضامنها مع مختلف أطراف حركة حقوق الإنسان في اليمن، التي باتت تعمل في ظل مناخ مروع تسعى من خلاله السلطات إلى سد كافة منافذ التعبير السلمي وخنق كافة الأصوات الناقدة للسياسات الكارثية للنظام اليمني، والتي تهدد بتقويض أو تمزيق ما تبقى من كيان الدولة المركزية.

وتدعو المنظمات الحقوقية الموقعة على هذا النداء السلطات اليمنية إلى الإفراج الفوري عن ياسر الوزير، واتخاذ إجراءات حازمة لوقف تدابير الاختطاف والإخفاء القسري والتعذيب والاعتقال التعسفي، التي بدت تمثل سلوكا منهجيا في ملاحقة الخصوم السياسيين والصحفيين المستقلين ومدافعي حقوق الإنسان.

وتشدد هذه المنظمات على مسئولية المجتمع الدولي في وضع حد للانتهاكات الواسعة التي باتت تستهدف بشكل متزايد قطاعات عريضة من المواطنين اليمنيين. وتناشد هذه المنظمات على وجه الخصوص مجلس الأمم المتحدة لحقوق الإنسان ومقرروه الخواص المعنيين بحالة المدافعين عن حقوق الإنسان، وبتعزيز وحماية الحق في حرية الرأي والتعبير، وبمسألة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللا إنسانية أو المهينة، وكذا الفريق العامل المعني بالاحتجاز التعسفي، والفريق العامل المعني بحالات الاختفاء القسري وغير الطوعي، اتخاذ التدابير المناسبة في إطار صلاحياتهم لحفز الحكومة اليمنية على وضع نهاية فعلية لهذه الانتهاكات الخطيرة وقطع الطريق على المخططات الحكومية، التي تستهدف تطويق وقمع مدافعي حقوق الإنسان؛ ومن ثم إخراس أصوات ضحايا انتهاكات حقوق الإنسان في هذا البلد.

In Furtherance of the Misuse of the Threat of Terrorism; Yemeni Human Rights Defender to Serve Eight Year Prison Term, in a Grave Abuse of his Rights



Press Release



The undersigned organizations wish to express their grave concern about the worrisome deterioration of the state of human rights in Yemen. The Yemeni authorities are increasingly taking retaliatory measures against human rights defenders who have the courage to expose human rights abuses in the country, both those occurring in the context of the war in Saada in the north and those accompanying the repression of social and political ferment in the south.

The undersigned organizations condemn in particular the unfair prosecution of rights defender Yasser al-Wazir, a member of the Yemeni Organization for the Defense of Rights and Democratic Freedoms, who just a few days ago was sentenced to eight years in prison. This wrongful punishment is only the most recent of a string of abuses targeting al-Wazir—abuses closely related to his activities as a rights activist and the role his organization plays in documenting abuses related to the war in Saada, where members of the Zaidi confession, who constitute a majority of the population in Saada, have been exposed to all manner of collective punishment, discrimination, and repression because of their faith.

Yasser al-Wazir was abducted more than 18 months ago by the political police. For more than three months, his whereabouts were unknown and he was denied family visits. It is believed that he was tortured and spent long stretches of time in solitary confinement during this period. Al-Wazir remained detained without charge until two months ago the authorities referred him to trial on trumped-up charges, including charges of forming an armed group, although al-Wazir was never questioned about this accusation.

His trial was conducted in semi-secret conditions, in closed sessions, and al-Wazir was not informed about the trial dates. His attorney did not attend the trial, which was conducted before the Special Criminal Court, a state security court whose constitutionality is questionable. Defendants in this court are not given the procedural and legal rights that guarantee due process and a fair trial.

The undersigned organizations express their full solidarity with Yasser al-Wazir and all members of the human rights movement in Yemen, which is currently working amid an atmosphere of fear in which the authorities are blocking all avenues of peaceful expression and silencing voices critical of the catastrophic policies of the Yemeni regime, which threaten to completely tear apart what remains of the central state structure.

We urge the Yemeni authorities to immediately release al-Wazir and take decisive measures to stop the kidnappings, forced disappearances, torture, and arbitrary arrest, which are standard tactics used to deal with political opponents, independent journalists, and human rights defenders.

We reiterate the international community’s responsibility for putting an end to abuses that are targeting ever-broader swathes of the Yemeni population. In particular, the undersigned organizations call on the UN Human Rights Council and its special rapporteurs—namely, the rapporteurs for human rights defenders, for the protection of the right to freedom of opinion and expression, and for torture and other inhumane punishment, as well as the UN teams working on arbitrary detention and involuntary disappearance—to take appropriate measures as defined by their mandates to encourage the Yemeni government to end these serious abuses and the government tactics used to repress human rights defenders and thus silence the voices of human rights victims in the country.
